WAIVER OF LIABILITY – F1RST CAMPUS

NOTICE: THIS IS A LEGALLY BINDING AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS, YOU MUST LEAVE THE F1RST CAMPUS IMMEDIATELY. REMAINING ON THE PREMISES SIGNIFIES YOUR AGREEMENT TO THESE TERMS. CONTACT THE OFFICE IF A REFUND IS NECESSARY.

1. ASSUMPTION OF RISK
I, on behalf of myself and my heirs, assigns, agents, beneficiaries, executors, and administrators, acknowledge that my presence at the F1RST Campus, including all associated facilities, training areas, and programs, involves inherent risks. These risks include, without limitation, the possibility of personal injury, death, or property damage arising from hazardous training environments, equipment, uneven surfaces, confined spaces, structural risks, exposure to training materials and techniques, and other unpredictable conditions. I understand and voluntarily assume all such risks, both known and unknown, related to my participation in or observation of activities at the F1RST Campus. I agree to follow all posted rules, guidelines, and instructions from the Pasco Sheriff’s Office and F1RST staff.

2. RELEASE, WAIVER, AND INDEMNIFICATION
In consideration of being allowed to visit, observe, or participate in activities at the F1RST Campus, I release and forever discharge the Pasco Sheriff’s Office, Sheriff Chris Nocco, Florida’s Forensic Institute for Research, Security, and Tactics (F1RST), any vendors contracted to be at F1RST, and all associated employees, agents, contractors, assigns, and successors from any and all claims, demands, or liabilities arising from personal injury, death, or property damage incurred while on the F1RST Campus, including theft, loss, or damage to personal property. This applies even if such injury, loss, or damage results from the negligence of the Pasco Sheriff’s Office, Sheriff Chris Nocco, F1RST, any contracted vendors, or their respective agents and employees. I further acknowledge and understand that participation or observation at the F1RST Campus is inherently dangerous and voluntarily assume all related risks. I agree to hold harmless and never sue the Pasco Sheriff’s Office, Sheriff Chris Nocco, F1RST, any vendors contracted to be at F1RST, or any agents, employees, assigns, and successors of the aforementioned entities for any and all claims, demands, or liabilities, including legal fees, that arise out of my presence, participation, or observation at the F1RST Campus. I also agree that I will not bring any lawsuit, cause of action, or legal claim based on any injuries, losses, or damages sustained, whether caused by my own actions or omissions or by the actions or omissions of any individual I bring onto the premises. I understand that my email address is public record and will be maintained by F1RST in accordance with Florida Law. I understand that F1RST will add my email to a distribution list for updates related to activities at F1RST and I may choose to unsubscribe from these emails at any time by clicking the link at the footer of any email. 

3. DISCLAIMER FOR TRAINING PROGRAMS AND CONTENT
The training programs, content, and materials presented at the F1RST Campus are provided for general educational and informational purposes only. F1RST does not guarantee the accuracy, applicability, or reliability of the information or techniques presented, and makes no warranties or claims that such information is complete, error-free, or suitable for any particular purpose. Reliance on the information or techniques provided is entirely at your own risk, and you should consult with your agency’s legal, training, or policy staff before implementing any material learned at F1RST. Neither F1RST, the Pasco Sheriff’s Office, Sheriff Chris Nocco, nor any contracted vendors or associated agents shall be liable for the improper or unlawful use of any information or techniques shared, nor for any direct, indirect, or consequential damages that may result from its use or application.

4. CONSENT TO ELECTRONIC TRANSACTIONS AND SIGNATURES
In accordance with the Florida Uniform Electronic Transactions Act (Florida Statutes, Sections 668.50 et seq.) you agree that your electronic signature (including checking a box, clicking an “I Agree” or “I Accept” button, using a digital signature platform, or providing a typed name) is the legal equivalent of your handwritten signature on this agreement. By signing or otherwise indicating acceptance electronically, you confirm that:

• You have read and understand the terms of this Waiver of Liability and Release.

• You intend to be bound by these terms.

• You consent to conduct business electronically.

• You have the ability to view, download, or print this agreement for future reference, and you understand it is your responsibility to maintain a copy.

5. ACCEPTANCE AND MODIFICATIONS TO AGREEMENT
By remaining on the premises of the F1RST Campus or by signing electronically, you confirm that you have read, understood, and agree to the terms of this Waiver of Liability and Release. If you do not agree, you must leave immediately. F1RST reserves the right to modify this agreement without notice, and it is your responsibility to review the most current version posted on the F1RST website at https://www.floridasfirst.org/waiver.

6. GENERAL TERMS
This agreement shall be governed by the laws of the State of Florida. If any provision is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect. This agreement constitutes the entire understanding between the parties and supersedes any prior agreements or representations related to liability at the F1RST Campus.
