WAIVER OF LIABILITY (INDIVIDUAL) - RUBBLE PILE

 

THIS IS A LEGALLY BINDING AGREEMENT. BY SIGNING THIS AGREEMENT, YOU GIVE UP YOUR RIGHT TO BRING A COURT ACTION TO RECOVER COMPENSATION OR OBTAIN ANY OTHER REMEDY FOR INJURIES OR DAMAGE TO YOURSELF OR YOUR PROPERTY ARISING OUT OF PARTICIPATION OR OBSERVATION AT THE PASCO SHERIFF’S OFFICE/F1RST RUBBLE PILE(S).

 

I acknowledge I am eighteen (18) years of age or older. I, and on behalf of my heirs, agents, assigns, beneficiaries, executors, and administrators, state that I understand the activity I have chosen to participate in and/or observe at the Pasco Sheriff’s Office Rubble Pile(s) (Rubble Pile) may be dangerous in that exposed concrete rebar, uneven and/or unsteady surfaces, sharp edges, enclosed spaces, shifting concrete blocks or structures, and other structural hazards may be present. I agree to read and abide by all the Rubble Pile Safety Rules and Regulations, and also agree to assume any and all risks associated with the use of the Rubble Pile, whether known or unknown, including, but not limited to: personal injury, including death, or loss of personal property through misplacement, loss, or theft while participating or observing Rubble Pile activities.

 

I, and on behalf of my heirs, agents, assigns, beneficiaries, executors, and administrators, for the consideration of being allowed to use and/or observe activities on the Rubble Pile, and other valuable consideration, do hereby absolutely and unequivocally agree to release, save, and hold harmless Florida’s Forensic Institute for Research, Security, and Tactics (F1RST), the Pasco Sheriff’s Office, Chris Nocco as Sheriff of Pasco County, and all of their agents, employees, assigns and successors in interest from any claim, demand, or liability (whether claimed by myself or another person or entity) which may arise out of any loss, damage, injury, or death which I may sustain, as well as any theft, unexplained disappearance, or damage which may befall my property accompanying me (during participation or observation of the Rubble Pile activities or while on the Rubble Pile premises) even if any loss, damage, injury, or death which I may sustain, including theft, unexplained disappearance, or damage which may befall my property arises from negligence of any kind of F1RST, Chris Nocco as Sheriff of Pasco County, or the Pasco Sheriff’s Office, and any of their officers, members, agents, or employees.

 

I, and on behalf of my heirs, agents, assigns, beneficiaries, executors, and administrators, agree to indemnify and hold harmless Chris Nocco as Sheriff of Pasco County, F1RST, and the Pasco Sheriff’s Office, and all of their agents, employees, members, assigns, and successors in interest for any and all damages caused by my use of the Rubble Pile property including, but not limited to, damages or personal injuries caused by my negligence and/or the negligence of other persons I brought to the Rubble Pile, and attorney fees and costs to defend any and all claims brought against F1RST, Chris Nocco as Sheriff of Pasco County, and/or the Pasco Sheriff’s Office, and all of their agents, employees, members, assigns, and successors in interest resulting from my participation in Rubble Pile activities or of other persons I brought to the Rubble Pile.

 

I further acknowledge the right of the F1RST and/or Pasco Sheriff’s Office members to immediately terminate my participation in Rubble Pile activities upon any failure of mine (or my guests) to fully comply with all Rubble Pile rules and policies and/or directions of any F1RST or Pasco Sheriff’s Office member or employee. I hereby state I am physically able to participate in Rubble Pile activities.
